They refer to a group of felony offenses that turn on what the State says happened with visual material, who was involved, what the defendant knew, and whether the allegation is possession, receipt, distribution, solicitation, recording, creation, or conduct tied to producing the material.<\/p>\n<p data-start=\"139\" data-end=\"1479\">North Carolina separates these allegations into first-degree, second-degree, and third-degree sexual exploitation of a minor, and the statutory differences matter because the elements, punishment level, and proof issues are not the same. First degree covers conduct such as using or permitting a minor to engage in sexual activity for a live performance or for the production of material, along with certain recording or creation-for-sale conduct. Second degree covers conduct such as recording, distributing, transporting, exhibiting, receiving, selling, purchasing, exchanging, or soliciting prohibited material. Third degree focuses on knowing possession.
