You don&#8217;t really know the impact this ticket can have on you, so I tell everyone that I represent: please never take legal advice from a police officer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It&#8217;s not their job to instruct you correctly, and sometimes it&#8217;s not in their best interest to tell you the real truth about what may happen to you.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So here we go. A a revoked license versus no license.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A revoked license means that the State of North Carolina has taken some action against you and said you are not allowed to operate a vehicle on our roads.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Not having an operator&#8217;s license \u2014 the little card they give you \u2014 is a different charge.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But if you are one of those people who have a revoked license and your charge has been dropped down to No Operator&#8217;s License, there are still serious consequences.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When your license is revoked in North Carolina, if you get charged with a moving violation, which is anything you can do while you operate a motor vehicle, you can still lose your license for another year for paying off that ticket.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So in this case, whether the person has No Operator&#8217;s License and the officer was nice and said, &#8220;I&#8217;m not going to charge you with a revoked license offense and I&#8217;m not going to take you to jail,&#8221; there are still serious consequences.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You should give us a call at Fanney Law Office. Gen. Stat. \u00a7 20-7(a) does not always trigger the additional revocation imposed for a moving violation committed while a license is revoked. Section 20-28.1 expressly excludes that offense unless it occurred in a commercial motor vehicle or the driver held a commercial driver\u2019s license at the time. The conviction does not remove the original revocation or authorize the driver to return to the road. The driver must still satisfy the court and NCDMV requirements associated with the underlying revocation.                 <\/p>\n            <\/div>\n        <\/div>\n    <\/section>\n\n\n\n    <section class=\"sc_fs_faq sc_card \">\n        <div>\n\t\t\t<h3>What is the difference between ordinary DWLR and DWLR for an impaired driving revocation?<\/h3>            <div>\n\t\t\t\t                <p>\n\t\t\t\t\t Ordinary Driving While License Revoked in North Carolina is generally a Class 3 misdemeanor under N.C. Gen. Stat. \u00a7 20-28(a). Driving While License Revoked for an Impaired Driving Revocation is a separate Class 1 misdemeanor under \u00a7 20-28(a1). A conviction for Driving While License Revoked for an Impaired Driving Revocation also results in an additional license revocation. The additional period is one year for a first conviction, two years for a second conviction, and permanent for a third or subsequent conviction.
