Hi. I’m John Fanney with Fanney Law Office. What I’m doing today is just answering question that people have posted on the internet that are very relevant questions. These are not real clients. These are people just like you who have put questions out there and are seeking a little legal advice.
The first question we have here is: My license is revoked and I just got a ticket, but the officer reduced it to driving without an operator’s license. He said it wasn’t a big deal. What should I do with it? I think I should just pay it off. The first thing I want to say is, every ticket is a big deal. You don’t really know the impact that this ticket can have on you. I tell everyone that I represent, please never take legal advice from a police officer. It’s not their job to instruct you correctly. Sometimes, it’s not in their best interest to tell you the real truth about what may happen to you.
Here we go. A revoked license versus no license. A revoked license means that the state of North Carolina has taken some action against you and said, “You are not allowed to operate a vehicle on our roads.” Not having an operator’s license, the little card they give you, is a different charge. If you are one of those people who have a revoked license and your charge has been dropped down to no operator’s license, there are still serious consequences. When your license is revoked in North Carolina, if you get charged with a moving violation, which is anything you can do while you operate a motor vehicle, you can still lose your license for another year for paying off that ticket. In this case, where the person has no operator’s license, and the officer was nice and said, “I’m not going to charge you with a revoked license offense and I’m not going to take you to jail,” there are still serious consequences.
